Sections IV, VI, X, and XII will remain applicable after this Agreement's termination.
IX. User Contributions and Behavior
On certain sections of the STAAR LABS platforms, users may post content ("User Contributions"). Note that these platforms are designed for mature audiences. Users under 13 should refrain from submitting any User Contributions.
You're accountable for your User Contributions, whether shared publicly or sent privately to STAAR LABS or another user. STAAR LABS aims to provide a secure environment but cannot ensure that others won't misuse shared User Contributions. Confidential or private content should be withheld from these platforms.
By sharing any User Contribution on the platform, you grant STAAR LABS an unrestricted, permanent, royalty-free, and fully transferable license to utilize, alter, combine, distribute,
display, and even create derivative works from such content globally. This includes any intellectual property rights associated with your User Contributions.
You guarantee that:
* You possess or have obtained the necessary permissions for your User Contributions.

You agree to cover any charges, fees, or payments due to rights infringements of your User Contributions.
STAAR LABS may keep User Contributions as necessary and disclose them if mandated by law or in good faith for legal compliance, agreement enforcement, or public safety protection.
Using the STAAR LABS platforms, you might encounter User Contributions from others that might be offensive. STAAR LABS does not oversee all User Contributions and isn't responsible for their content or accuracy.
You commit to:
* Not sharing content that is illegal, harmful, abusive, or offensive.
* Protecting minors.
* Not impersonating or misrepresenting affiliations.
* Not sharing any unauthorized, misleading, or harmful content.
* Respecting the intellectual property rights of others.
Violators may face account termination. You are responsible for interactions with other users. STAAR LABS may monitor these interactions but isn't obliged to intervene in disputes.
X. Jurisdiction; Arbitration & Class Action Waiver

Federal Arbitration Act and related federal regulations govern this section.
Disagreements or claims related to your use of STAAR LABS platforms or services will be resolved via arbitration, not in court. Both parties waive rights to class, consolidated, or representative actions.
To initiate arbitration against STAAR LABS, send a claim description to STAAR LABS' designated agent.
The American Arbitration Association (AAA) will oversee the arbitration following its guidelines at www.adr.org. AAA rules will determine arbitration costs. STAAR LABS covers attorney fees only in cases of baseless claims.
All parties confirm that any dispute resolution will be individual-based. You waive rights to class actions. Arbitration awards are legally binding and can be enforced in any court with jurisdiction.
Claims regarding intellectual property rights misuse can be pursued in court, waiving any right to a jury trial.
XI. Validity and Understanding
Should any clause of this Agreement be found invalid or unenforceable, the rest remains intact and enforceable. The term "including" in this Agreement implies "without limitation."
XII. Sole Agreement
This Agreement stands as the singular pact between STAAR LABS and every user of the platforms, overriding any prior commitments, understandings, or agreements, be they oral or written, regarding this subject.
XIII. Other Provisions
Any lack of insistence by STAAR LABS Parties on strict compliance with this Agreement does not equate to a waiver of any clause. It doesn't limit the party's right to demand strict compliance in the future, either.
XIV. Respect for Intellectual Property
STAAR LABS values the intellectual property rights of others and expects its platform users to do the same. If you suspect any infringement of your intellectual property, please relay the following details to STAAR LABS’ Copyright Agent, as outlined under the Digital Millennium Copyright Act, 17 U.S.C. § 512(c)(2):
- Actual signature of the authorized person acting on behalf of the copyright holder;
- Details of the copyrighted material you believe has been infringed;
- Location of the potentially infringing material on the Service;
- Your contact details: address, phone number, and email;
- A statement expressing your belief that the usage of the material wasn't authorized by the copyright owner, its agent, or the law;
- A sworn statement confirming the accuracy of the provided information and affirming you are either the copyright holder or authorized to represent them.

STAAR LABS INC Shipping & Returns Policy
1. Order Processing:
Orders placed before 12 PM (EST) on business days are processed on the same day.
Orders made after 12 PM (EST) or during holidays/weekends will be processed on the next

Unused items can be returned within 30 days of the purchase date.
To be eligible for a return:

We guarantee the quality, purity and potency of our products through their expiration date. Returns must be made within 30 days from receipt and require preauthorization. Any claims of shortage or damage must be made within 7 days of receiving the package. Authorized returns must be received within 14 days of authorization. All returns will be credited upon receipt and are subject to a 15% processing fee and cost of shipping.
When you receive your item, you must check it as soon as possible following receipt and always before use. You have 14 days to return your order under our 14-day return period policy, which starts on the day after you received the item. It’s so simple, please follow the steps set out below (please see the section headed ""Returns and Refunds"") All items must be returned unused and in the original packaging as they were in when received by you. Please ensure that when you receive an item that you take reasonable care of it when trying it /inspecting it eg. please ensure that any security seals or tags are still intact.
Wrong item received. We apologize if you have received the wrong item by mistake. This is not common, and we want to resolve this as quickly as possible for you. To receive a refund or a replacement, you must return the item in the same condition you received it and within 14 days from the day on which you received the item.
Damaged or faulty items. Please accept our apologies if you have received an item that is damaged or faulty. We understand how frustrating this can be and want to resolve this as quickly as possible for you. If you believe that the item is faulty, please contact us. You will need to tell us exactly what the fault is and as soon as possible after discovering the fault and we will advise what to do next. Our Returns Policy for faulty items upholds your statutory rights.
Item not received. We apologize if you have not received your item. This is not common, and we want to resolve this as quickly as possible for you. To receive a refund or a replacement, you must inform us that you have not received your item within 21 days from the day on which you received an email from us confirming that the item had been dispatched.
To return your item Contact us through your account via our online message center. You must inform our customer service team of your order number, the item you are returning and the reason for return. We will then provide you with a unique returns authorization number and will confirm the address you need to return the item to please package the item securely and include inside the package your order number, name and address. Please obtain a proof of postage from the Post Office when you send your item to us. Proof of postage does not cost anything without it, however, we may not be able to process your refund or replacement in the rare event that your item is lost in transit If you request a replacement and the product is no longer available, we will process the refund back to the original method of payment used to purchase the item. Any item you have accepted and then return is your responsibility until it reaches our warehouse. Please therefore ensure that you send your item back to us using a delivery service that insures you for the value of the products.
What we’ll do next. All products returned to us are checked by our Returns Department. If you are entitled to a refund, then we will refund the price of your item. Returns are usually processed within 7 working days of receipt of a canceled order, and at the latest within 30 days of receipt. We will refund the original method of payment used to purchase the item.
Return of replacement products. If an item you ordered was found to be faulty and we replaced it, you have the right to cancel your order in respect of the replacement product within 7 working days starting on the day after you received the replacement item and receive a refund.
Cost of returning items. Please note that we can only refund the postage costs for returning an item where: we sent you the wrong item, or the item is damaged or faulty; or where you are returning a substitute or replacement item which you do not want to keep. We will not refund postage for items found to be in good working order. Costs of posting the item back to you will depend on the item and will be communicated to you after the testing process has been completed.
